Verdict

Joshua F. PERKINS vs John R. WHITE

In this case came the parties by these Attornies there upon came the same jury who were (undecipherable) from rendering their verdict yesterday, to wit: Ephraim Osborn, Isaac Greer, David Wagner, Jas W. Cable, W. B. Dunn, Washington Cole, David L. Barry, Caloway Elrod, Morgan Smith, Alfred Bowman, Jas. W. W. Grayson, Allen Noten, who upon their oath aforesaid say that they find the case formed in favor of the Defendant. Thereupon the Plaintiff by his Attorney Thos. A. R. Nelson and moves the Courts for a new trial, which motion is discharged by the Court. It is therefore carried over by the Court that the Defendant receive of the Plaintiff one Joshua Perkins his security of word (undecipherable) in the prosacution from the costs of this case for which execution may issue from when opinion of the Court in overuling Plff’s. motion for a new trial and entering judgement, the Plaintiff proves an appeal to the in the nature of a writ of error to the next term of the (undecipherable) minie Court of Errors and Appeals to be held at the Court House in the City of Taylorsville on the second Monday in September next which is granted him by having (undecipherable) identity as negroid by law. During the progress of this case the Plaintiff by his council tendered a Bill of Exceptions which was (undecipherable) and (undecipherable) by the Court and made part of the record.
